Do’s and don’ts when you receive a call or notice from police when wife files false case against you
There is no secret that the laws of our country are gender-biased favouring women irrationally. It has become very common for women in India to misuse these laws and file false cases on their husbands to settle personal score or clear personal vendetta. More often than other, in due course of time, the cases are found to be frivolous. In most cases, the wife files a complaint in CAW cell of police station for IPC 498A which is criminal in nature. Usually this section is coupled with other sections such as IPC 406, IPC 504, IPC 506, IPC 323 and others. Upon taking the complaint, the role of CAW police initiates and you are required to interact with the police officer or Investigating Officer. Here are some Do’s and Don’ts you should keep in mind while dealing with police:
Never panic: Avoid having any panic or fear when you receive a call or notice from police station. You may lose your ability to think rationally while in fear and are more likely to commit mistakes.
Watch you conduct: While dealing with police, maintain a calm composure and avoid getting aggressive or emotional. It is important to demonstrate your decent behaviour in front of police.
Don’t rush for Anticipatory Bail: Most people immediately engage a lawyer in the initial stage of interaction with police. At this stage the lawyers lure victims to apply for Anticipatory Bail to avoid possible arrest which may turn unnecessary in due course of time.
Know the powers of police: The police machinery is designed to favour women. They are naturally against men and would investigate the matter in the same manner. It is important to learn about the duties and powers of police or investigating officer before you enter in the police station. Learning about your rights as citizen of India would be an added advantage.
Co-operate with the investigation: As soon as the FIR gets registered in police station, the formal investigation starts. At this stage, ask for 41A notice and comply with the investigation proactively. If you are co-operating in the investigation, there is no reason for police to arrest you.
